1.    Purpose of SMS Communications

Swimathon Foundation ("we"/"us"/"our") uses SMS text messages to send you key event updates relating to your participation in Swimathon events, including important service and operational communications. These are not marketing messages. They are service communications necessary for the proper administration and delivery of the events and services you have signed up for.

These messages may include:

1. Key event updates and important reminders

2. Important changes to schedules, venues or logistics

3. Registration and participation confirmations

4. Event-day communications (e.g. safety information, timings, location updates)

5. Fundraising updates related to your participation

6. Urgent operational or welfare information

2.    Legal Basis for SMS Communications

Under the UK General Data Protection Regulation (GDPR)/Data Protection Act 2018, we may send you SMS communications on the following legal bases:

1. where it is necessary to perform the contract we have entered into with you when you registered for Swimathon;

2. where it is necessary for our legitimate interests in delivering the events and services you have signed up for, and your interests and fundamental rights do not override those interests; and/or

3. where we need to comply with a legal obligation (for example, to communicate urgent safety information).

By providing your mobile telephone number to Swimathon Foundation when you register for an event or use the MySwimathon dashboard, you acknowledge that we may use this number to send you service-related SMS communications as described in our Privacy & Cookie Policy.

3.    Message Frequency

The frequency of messages will vary depending on your involvement with Swimathon events and the timing of those events. You can expect to receive more messages in the period leading up to and during an event. We will limit messages to what is reasonably necessary for operational and service purposes.

4.    Costs and Delivery

Swimathon Foundation does not charge for sending SMS messages. However, standard message and data rates from your mobile network provider may apply. Please contact your provider if you have questions about your text or data plan.

SMS delivery is dependent on mobile network availability. Swimathon Foundation and its SMS service provider cannot guarantee the timely or successful delivery of all messages. Mobile carriers are not liable for delayed or undelivered messages. Swimathon Foundation is not liable for any delays or failures in message delivery that are outside our reasonable control.

5.    Your Mobile Number

It is important that all the Personal Information you give us when you register is correct and accurate. This includes ensuring that we have your correct mobile telephone number at all times.

Please ensure that the mobile number you provide to us is accurate and up to date. If you change your mobile number or transfer it to another person, please notify us immediately at info@swimathon.org so that we can update our records.
